A restraining order, also known as a protective order, gives a victim certain rights against her abuser. You can obtain a restraining order by completing a petition and attending a hearing to explain your case.
Function
A restraining order is an injunction signed by a judge that provides legal protection to victims of domestic abuse, stalking and other forms of harassment.
Types
The three main types of restraining orders are emergency protective order, temporary restraining order and permanent restraining order.
Benefits
In addition to offering a victim protection from a stalker or abuser, restraining orders also address issues such as disallowing the abuser from purchasing or possessing firearms and removing children from their state of residence.
Time Frame
An emergency protection order is usually in effect for a week. A temporary restraining order normally lasts for 1 month or less, and a permanent restraining order lasts for a predetermined number of years set by a judge.
Considerations
In order to obtain any restraining order, you must be able to prove during a hearing that you have been abused, harassed or otherwise violated and be able to demonstrate why you require protection.
